1 Who we are and how to contact us

MA Design Chester LTD, trading as German Kitchen Outlet, is the controller responsible for the personal information covered by this policy. In this policy, “we”, “us” and “our” mean MA Design Chester LTD. A controller decides why and how personal information is used.

For privacy enquiries, requests or complaints, contact us using the details below. Please mark written correspondence “Privacy”.

Telephone: 01244 295 011
Postal address: MA Design Chester LTD trading as German Kitchen Outlet, Unit 2, 157–167 Foregate Street, Chester, CH1 1HF

We handle personal information under the UK General Data Protection Regulation, the Data Protection Act 2018 and applicable electronic communications and privacy law, as amended.

2 The information we collect

The information we hold depends on how you interact with us. It can include:

Enquiry details: your first and last name, email address, telephone number and postcode.

Kitchen project details: your preferred kitchen style, budget range, approximate installation timeframe, kitchen size, and other information you provide about your project.

Consultation and customer records: appointment details, correspondence, design requirements, measurements or plans you provide, quotations and, if you place an order, delivery details, order records, payment status and aftercare information.

Technical information: IP address, browser and device details, website activity, referral or advertising information, and cookie or similar identifiers, depending on the features you use and your privacy choices.

Privacy preferences: marketing choices, cookie choices, consent records, objections and records of requests or complaints.

We do not need sensitive personal information, such as health information, for the enquiry form. Please avoid including it unless we specifically explain why it is needed and how it will be handled.

3 How we obtain your information

We collect information directly from you through our online form, email, telephone calls, consultations and other correspondence. Technical information is collected through the website and its service providers, subject to the choices described in section 7.

If someone contacts us on your behalf, or you ask another service to send us an enquiry, we may receive your contact and project details from them. Where required, we will explain the source and provide this policy when we first contact you, or within the applicable legal timeframe.

You are not legally required to make an enquiry. However, we need the required contact and project details to respond, assess your requirements and arrange a consultation. Without them, we may be unable to provide the service you request. Optional marketing consent is not a condition of making an enquiry or buying a kitchen.

4 Why we use your information and our lawful bases

Enquiries, consultations and quotations. We use contact and project details to respond to your request, discuss suitable kitchens, arrange appointments and prepare designs or quotations. Our lawful basis is taking steps at your request before entering into a contract. For general questions unrelated to a prospective contract, we rely on our legitimate interest in responding to business enquiries.

Orders and aftercare. If you become a customer, we use relevant information to fulfil your contract, arrange supply, delivery or installation, and provide agreed aftercare. We also process records where necessary to meet legal obligations, including accounting, tax and applicable consumer law obligations.

Website operation and security. We use necessary technical information to deliver the website, manage enquiries, troubleshoot problems and prevent fraud, spam or misuse. We rely on our legitimate interests in operating a reliable service and protecting customers, staff and systems. Any consent requirements for device storage or access apply separately.

Marketing. We use your details for optional marketing with your consent, or on the basis of our legitimate interest in promoting our own relevant services where electronic marketing rules permit this. Section 5 explains the conditions and your right to opt out.

Optional analytics and advertising. Where these tools are used, we rely on consent for the optional tracking and related personal information processing described in section 7. Refusing this consent does not prevent you from making an enquiry.

Administration, rights and disputes. We process information to meet data protection and other legal obligations. We also rely on legitimate interests where necessary to manage business records, investigate concerns and establish, exercise or defend legal claims.

Where we rely on legitimate interests, we consider the effect on your rights and use information only where our interests are not overridden by your interests or fundamental rights. Contact us for more information about the assessment relevant to your data.

5 Enquiry follow up and marketing

When you request a consultation or quotation, we use your details to respond and follow up about that request, including by telephone, email or text where appropriate. Submitting an enquiry does not automatically subscribe you to unrelated or ongoing promotional messages.

We send promotional emails or texts to individuals where you have consented, or where the “soft opt-in” applies: we obtained your details directly during a sale or genuine negotiations for a sale, the messages concern our own similar products or services, and we offered a clear opt-out both when collecting your details and in every message. We do not treat every enquiry as automatically satisfying these conditions.

Any live marketing calls must comply with applicable telephone marketing rules, including screening against relevant preference registers and our own suppression records, unless an applicable permission allows the call. Where consent is required, we obtain it first.

You can object to direct marketing at any time, and we will stop using your information for that purpose. Use the unsubscribe option in a message or contact us using section 1. We may keep a limited suppression record to respect your choice. Necessary communications about an existing appointment or order can continue.

6 Who we share information with

We share relevant information only where needed for the purposes in this policy. Recipients can include:

Our authorised staff and service providers supporting website hosting, online forms, customer records, email, telephone systems, IT support and security.

Marketing agencies acting on our instructions, and analytics or advertising providers where the processing described in section 7 is enabled lawfully.

Designers, kitchen manufacturers, delivery providers, installers and aftercare providers where needed to prepare or fulfil the services you request.

Professional advisers, insurers, regulators, courts and public authorities where necessary for advice, legal obligations or legal claims.

Providers acting as our processors are required to protect the information and use it only under our instructions. Some recipients act as independent controllers for their own legal or professional responsibilities; their own privacy information applies to that processing. We do not give unrelated businesses permission to market to you merely because you have submitted our form.

7 Cookies Google Analytics and Google Ads

We use Google Analytics to understand how visitors use our website and Google Ads to advertise our services and measure the enquiries generated by our advertising. Google is our analytics and advertising technology provider. Cookies and similar technologies can store information on your device or read information from it.

Your choices. Google Analytics and Google Ads measurement tags are blocked until you give the relevant consent. Our cookie banner lets you accept or reject optional cookies and choose between analytics and advertising measurement. Continuing to browse is not consent. You can revisit your choices through the “Cookie Settings” control in the website footer. We remember your cookie preference for six months, unless you change it or clear the relevant browser storage sooner. You can still make an enquiry if you reject optional cookies.

Google Analytics. With your consent, this service processes information about pages visited, referral sources, interactions, browser and device details, approximate location and online identifiers. We use the resulting reports to improve the website and assess its performance. Analytics cookies, including the “_ga” cookie and related identifiers, can remain on your device for up to two years, unless removed sooner. Cookie expiry can be renewed by later visits. Our retention period for Google Analytics user and event-level data is 14 months; this is separate from cookie expiry. We do not send names, email addresses, telephone numbers or free-text enquiry content to Google Analytics.

Google Ads conversion measurement. With your consent, we use advertising click identifiers, cookie identifiers and conversion events, such as a completed enquiry, to understand which advertisements lead to contact with us and to improve campaign performance. Google Ads first-party conversion cookies beginning “_gcl_” generally last for 90 days. We use standard conversion measurement and do not upload customer lists or contact details through Customer Match or enhanced conversions. We do not use website remarketing audiences or Google Signals for personalised advertising.

Essential technologies and embedded features. Technologies needed to provide the website or a service you request, maintain security or remember your privacy choices may operate without optional cookie consent where the law permits. The website also includes Google Maps, Google-hosted fonts and an Elfsight visual feature. When external features load, their providers may receive your IP address, browser details and the page requesting the content. Where a feature involves device storage or access requiring consent, it is blocked until you agree. Our cookie controls identify any optional embedded features separately.

Google explains how it uses information from websites using its services at https://policies.google.com/technologies/partner-sites and describes its cookies at https://policies.google.com/technologies/cookies. You can also manage relevant Google account advertising choices at https://myadcenter.google.com. These controls supplement the choices available on our website.

8 International transfers

Google operates internationally, and information processed through its services may be transferred outside the UK, including to Google LLC in the United States. Our hosting and other technical service providers may also use infrastructure or support teams outside the UK.

Where a transfer is covered by UK adequacy regulations, we rely on that recognised level of protection. For eligible transfers to Google LLC in the United States, this includes the UK Extension to the EU–US Data Privacy Framework while the relevant certification and adequacy arrangement apply. Where a restricted transfer is not covered by adequacy, we require appropriate safeguards, such as the UK International Data Transfer Agreement or the UK Addendum to approved standard contractual clauses, with the assessment and additional measures required by law.

Google publishes its transfer arrangements at https://policies.google.com/privacy/frameworks. Contact us using section 1 for details of the safeguards relevant to your information or to request a copy.

9 How long we keep your information

We retain information only for as long as needed for the purpose for which it was collected, including applicable legal, accounting and claims requirements. Our retention periods are:

Information

Retention

Enquiries that do not become orders

12 months after the last meaningful contact about the enquiry, unless you ask us to keep an active project open for longer.

Customer orders and related records

Six years after completion of the contract. Accounting and tax records are kept for six years from the end of the last company financial year they relate to, or longer where legally required. Relevant warranty records may be kept for the warranty period if longer.

Google Analytics information

14 months for user and event-level data. Aggregated reports that no longer identify individuals may be kept longer. Analytics cookies may last up to two years, as explained in section 7.

Google Ads information

First-party conversion cookies generally last for 90 days. Any identifiable conversion records we export are kept for up to 12 months for campaign analysis. Google applies its published service retention arrangements to information held in its systems.

Marketing preferences and suppression records

While needed to operate your choices; limited suppression information may be retained to prevent unwanted future marketing.

Consent evidence complaints and rights requests

Up to six years after the relevant processing ends or the matter is closed, where needed to demonstrate compliance or address legal claims. We review these records and delete information earlier where no longer needed.

Where a specific dispute, investigation or legal duty requires longer retention, we keep only the relevant information for as long as justified. We then securely delete or anonymise it, with backup copies removed through the applicable backup cycle. Google explains its own retention approach at https://policies.google.com/technologies/retention; our Google Analytics setting does not set the retention period for every Google Ads record.

10 Your data protection rights

Depending on the circumstances, you have the right to:

Ask for access to your personal information and a copy of it.

Have inaccurate information corrected and incomplete information completed.

Ask for information to be erased or its use restricted where the legal conditions apply.

Object to processing based on legitimate interests, including relevant profiling. Your right to object to direct marketing is absolute.

Receive eligible information in a portable format where processing is automated and based on consent or contract.

Withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal.

Complain to us and to the UK data protection regulator.

To exercise a right, use the contact details in section 1. We may request information reasonably needed to verify your identity or understand your request. We normally respond within one calendar month. Where the law permits an extension for complex or multiple requests, we may take up to two additional months and will explain the extension within the initial deadline. Requests are normally free; any lawful fee or refusal will be explained.

11 Automated decisions and profiling

We do not use solely automated decision-making that has legal or similarly significant effects on you. We use your kitchen preferences and project details to prepare for your consultation. Google Ads may use automated analysis of advertising interactions and conversions to optimise advertising performance, but this does not decide whether you can obtain a kitchen, receive a quotation or enter into a contract with us. You can contact us to discuss how your information has been used.

12 Keeping information secure

We use appropriate technical and organisational measures to protect personal information against unauthorised access, loss, misuse or disclosure. These include limiting access to people who need it for their work and requiring service providers to protect the information they handle. No internet service can guarantee absolute security.

13 Complaints

You have the right to complain to us if you believe we have mishandled your personal information. Contact us by email, telephone or post using section 1. Please explain your concern and how we can contact you. You do not need to use legal terminology or a special form.

We will acknowledge your complaint within 30 days of receiving it, investigate and respond without undue delay, keep you informed of progress where appropriate, and explain the outcome.

You also have the right to complain to the UK data protection regulator. Information about its complaints process is available at https://ico.org.uk/make-a-complaint/. You can contact the regulator on 0303 123 1113 or write to Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF.

14 Changes to this policy

We may update this policy when our services, processing activities or legal requirements change. The latest version will appear on this website with its updated date. Where required, we will tell you about significant changes before using your information for a new purpose and obtain any necessary consent.
